These Terms ("Terms") govern your access to and use of Creapic’s services ("we", "us"), a company based in France, providing AI‑powered food image generation for designers to incorporate into visual assets (e.g., menu boards). By using the service, you agree to these Terms.

1. Service scope

Creapic provides tools to generate food images from prompts. We do not produce or operate the final menu boards; you (or your vendors) integrate our images into your creations.

2. Account and security

You must provide accurate information, keep your credentials confidential, and notify us of any unauthorized use. We may suspend an account for legitimate reasons (fraud, non‑payment, breach).

3. Plans, pricing, and payments

Prices and plans are listed on our website and may change. Payments are processed by third‑party providers. Trial plans may convert to paid unless you cancel. Applicable taxes (e.g., VAT) may apply.

4. Rights to outputs (generated images)

Subject to full payment and compliance with these Terms, we grant you a non‑exclusive, worldwide, transferable right within your organization to use, reproduce, modify, and distribute generated images for lawful commercial purposes. We claim no exclusive rights over your outputs.

You represent and warrant that your prompts and use of images comply with applicable laws, including copyright, likeness rights, trademarks, fair commercial practices, and food regulations (presentation, claims, allergens). You are solely responsible for your inputs and exploitation of outputs.

5. Acceptable use

Prohibitions: (i) unlawful or harmful use, (ii) attempting to recreate the model or extract datasets, (iii) submitting sensitive personal data, (iv) infringing third‑party rights, (v) deepfakes for deceptive or illegal content.

6. Intellectual property

We retain all rights in our service, models, software, and marks. No assignment is made. Your prompts and outputs belong to you, subject to third‑party rights and compliance with these Terms.

7. Unlawful content

We may remove/suspend access to content or accounts if we reasonably believe they violate law or these Terms. Report abuse at admin@creapic.click.

8. Availability and maintenance

The service is provided “as is.” We may conduct planned or emergency maintenance. We use reasonable efforts for availability without guaranteeing uninterrupted service.

9. Warranties – disclaimer

To the extent permitted by law, the service and generated images are provided “as is,” without warranties of fitness, accuracy, or non‑infringement. You bear the risks related to regulatory compliance of food visuals, claims, allergens.

10. Liability – limitation

To the fullest extent permitted under French and EU law, our aggregate liability for any claim is limited to the amount you paid in the 12 months preceding the event. We are not liable for (i) lost profits, (ii) data loss not caused by our proven fault, (iii) indirect, special, consequential damages.

Nothing excludes liability for death or personal injury caused by our negligence, or liability that cannot be excluded by mandatory law.

11. Indemnification

You will indemnify us against third‑party claims arising from your use of the service or outputs in violation of law or these Terms.

12. Personal data

Personal data processing is governed by our Privacy Policy. You agree to submit only necessary and lawful personal data and to obtain consents where required.

13. Term and termination

The agreement is open‑ended. You may terminate at any time from your account (effective at the end of the current period). We may terminate/suspend for material breach or legal requirement.

14. Governing law and jurisdiction

These Terms are governed by French law. Disputes are subject to the competent courts of Paris, without prejudice to mandatory consumer protection rules where applicable.

15. Changes

We may amend these Terms. The current version is posted with its effective date. For material changes, we will notify you by reasonable means.
